The terms governing your access to Hop software, hosted backbones, and developer tools.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you", or "your") and Hop Mesh, LLC ("Hop", "Company", "we", "us", or "our"). [Counsel placeholder: state of organization and entity jurisdiction to be inserted upon confirmation of corporate filings.] By accessing or using our website, developer dashboard, API keys, hosted relay backbone, or telemetry infrastructure (collectively, the "Hosted Services"), you agree to be bound by these Terms.
You represent and warrant that you are at least 18 years of age (or the age of legal majority in your jurisdiction) or at least 13 years of age with the consent and supervision of a parent or legal guardian. If you are under 13 years of age, you may not use the Hosted Services or register for an account (Children's Online Privacy Protection Act, COPPA). If you are accepting these Terms on behalf of an organization, you represent and warrant that you have the authority to bind that organization, and "you" refers to that organization.
Hop provides delay-tolerant mesh networking software and services under a hybrid model:
To access the Hosted Services or obtain routing credentials, you must create an account and generate an API key or routing access token (RAT). You are responsible for safeguarding your credentials, configuring proper key rotation, and all activities that occur under your account.
Your use of the Hosted Services must comply with our Acceptable Use Policy. You agree not to transmit malware, conduct denial-of-service attacks, attempt unauthorized access to infrastructure, or circumvent billing meters or rate limits.
Access to the Hosted Services is billed according to the usage rate card on our Pricing page, measured asynchronously at our edge:
All fees are exclusive of taxes, which will be billed where applicable. Invoices are charged automatically via your payment method on file. Unpaid balances may result in account suspension.
Hop is designed to be fail-open. If your account hits a spending cap, fails payment, or is suspended for billing:
We reserve the right to immediately terminate access or revoke access keys for material breaches of our Acceptable Use Policy.
Message payloads are end-to-end encrypted before leaving your devices; our relays process ciphertext and cannot inspect payload contents. Our collection and handling of account metadata and billing usage are governed by our Privacy Policy and, where applicable, our Data Processing Addendum.
THE HOSTED SERVICES AND SOFTWARE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. HOP DOES NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FULLY IMMUNE TO PACKET LOSS IN DEGRADED OR DISCONNECTED ENVIRONMENTS.
NO 911 OR EMERGENCY SERVICES: HOP IS NOT A TELECOMMUNICATIONS CARRIER OR A REPLACEMENT FOR TRADITIONAL EMERGENCY DISPATCH SERVICES. THE HOSTED SERVICES AND SOFTWARE DO NOT CONNECT TO 911, ENHANCED 911 (E911), PUBLIC SAFETY ANSWERING POINTS (PSAPS), OR EQUIVALENT EMERGENCY SERVICES IN ANY JURISDICTION. HOP IS DELAY-TOLERANT, BEST-EFFORT MESH NETWORKING SOFTWARE AND IS NOT CERTIFIED FOR LIFE-CRITICAL, EMERGENCY RESCUE, OR LIFE-SAFETY COMMUNICATIONS. YOU MUST ENSURE THAT USERS HAVE ALTERNATIVE MEANS TO CONTACT EMERGENCY SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HOP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE HOSTED SERVICES. HOP'S AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO HOP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
BINDING INDIVIDUAL ARBITRATION: EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT OR PROCEEDINGS SEEKING INJUNCTIVE RELIEF FOR INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS, YOU AND HOP AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, THE SOFTWARE, OR THE HOSTED SERVICES SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) IN ACCORDANCE WITH ITS COMMERCIAL ARBITRATION RULES. ARBITRATION HEARINGS SHALL TAKE PLACE IN DELAWARE OR VIRTUALLY AS MUTUALLY AGREED.
CLASS ACTION WAIVER: YOU AND HOP AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS OR PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
JURY TRIAL WAIVER: YOU AND HOP EXPRESSLY AND IRREVOCABLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE HOSTED SERVICES.
You agree to comply with all applicable United States and international export control laws and economic sanctions regulations, including the Export Administration Regulations (EAR, 15 C.F.R. Parts 730-774) administered by the US Department of Commerce Bureau of Industry and Security (BIS) and sanctions programs administered by the US Department of the Treasury Office of Foreign Assets Control (OFAC). You represent and warrant that neither you nor any of your affiliates, directors, officers, or end users: (a) is located in, organized under the laws of, or ordinarily resident in any country or territory subject to comprehensive US territorial embargoes (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine); (b) is identified on any US government restricted party list, including the Specially Designated Nationals and Blocked Persons (SDN) List, the Denied Persons List, or the Entity List; or (c) will access, export, re-export, transfer, or use the Hosted Services in violation of US export controls or sanctions programs.
Enterprise and public-sector deployments requiring negotiated Master Services Agreements (MSA), custom Service Level Agreements (SLA), or dedicated infrastructure may execute custom agreements that supersede these standard Terms.
